Terms and Conditions of Use

These Terms and Conditions (hereinafter “Terms”) govern the access and use of the website, mobile applications, and any other services (collectively, the “Platform”) offered by Top World Hotel LTD, a limited liability company subject to the laws of England and Wales, with its registered office at 71-75 Shelton Street, London, WC2H 9JQ (hereinafter “Top World Hotel”, “Topworldhotel.com”, “we”, “us” or “our”). By accessing, browsing, and using the Platform, the User (hereinafter “User”) represents that they have read, understood, and fully accept these Terms. Should the User not agree to these conditions, they are required to refrain from using the Platform.

1. Description of the Service and Scope of Application

1.1 Nature of service

Top World Hotel operates exclusively as a metasearch engine for comparing rates, availability, and information related to hotels and other travel services. The Platform collects, aggregates, and displays data from affiliated platforms and websites (e.g., Booking.com, Expedia, etc.) through the use of APIs and direct links, without assuming in any way the role of a contractual intermediary or direct booking manager.


1.2 Purpose and Mode of Use

  • The Platform is for informational purposes only: the User may consult data regarding rates, availability, promotions, and conditions offered by third-party providers.
  • Through specific hyperlinks, the User will be redirected to the website or platform of the Hotel or affiliated partner, where they may complete the booking and payment process independently.
  • Should Top World Hotel provide, for certain functionalities, support in managing payments via third parties, each transaction and the conditions related thereto shall be governed exclusively by the third-party affiliate, with Top World Hotel assuming no responsibility whatsoever.

1.3 No Assumption of Contractual Liability

The use of the Platform does not in any way constitute the formation of a contractual relationship between the User and Top World Hotel regarding the booking or purchase of services offered by third parties. Any contractual relationship will be established directly between the User and the third party (Hotel or affiliated platform) at the time of booking.

2. Definitions

  • For “Top World Hotel”, “Topworldhotel.com”, “we” or “our” the term refers to TOP WORLD HOTEL LTD.
  • “Platform” means the website, mobile application, and/or any other IT tool made available for accessing the Service.
  • “Hotel” means the provider of accommodation and other travel-related experiences whose data is aggregated on the Platform.
  • “Service” means all functionalities related to data comparison, rates and availability, as well as the act of redirecting to the websites of third-party providers, as made available on the Platform.
  • “Booking” means the act of ordering or requesting a reservation for a stay or another travel service, which the User performs on the affiliated website.

3. Operational Methods of the Platform

3.1 Collection and Display of Data

  • The Platform collects data and information (rates, availability, promotions, reviews, etc.) through programmatic interfaces (APIs) and direct links provided by affiliated platforms and third parties.
  • Such data is provided “as is,” and Top World Hotel does not guarantee the completeness, accuracy, or timeliness of the information displayed.

3.2 Redirection and Informational Role

  • When selecting a particular offer, the User, by clicking on the corresponding link, will be redirected to the website or platform of the third party.
  • Once redirected, the User will interact solely with the third-party website or platform. Top World Hotel does not exercise any control over the content, contractual terms, or security measures adopted by such entities and therefore disclaims any responsibility in this regard.

3.3 Payment Management

  • Any payment operations carried out through the Platform (managed via third parties) shall remain subject to the regulations of the affiliated third party.
  • Any issues, disputes, or requests related to transactions, charges, refunds, or pre-authorizations must be addressed exclusively to the affiliated partner with whom the User has established the contractual relationship, thereby excluding any liability on the part of Top World Hotel.

3.4 Security and Technical Measures

Top World Hotel adopts technical and organizational security measures appropriate to protect the data transmitted through the Platform, in accordance with industry best practices and applicable regulations. However, the User acknowledges that, as the service is based on redirection to third-party platforms, the security of data relating to transactions and payment operations depends exclusively on the measures adopted by the affiliated third party.


3.5 Indemnification Clause

The User agrees to indemnify and hold harmless Top World Hotel, its directors, employees, and affiliates from any liability, cost, expense, damage, or claim (including reasonable legal fees) arising from the improper use of the Platform or the use of the affiliated links, as well as from any claims brought by third parties in connection with the use of services offered by such third parties.

4. Exclusion and Limitation of Liability Clauses

4.1 General Disclaimer of Liability

Top World Hotel provides the Service on an “as is” and “as available” basis and, to the fullest extent permitted by law, disclaims all liability for:

  • Errors, omissions, inaccuracies, or delays in the information provided;
  • Any interruptions or malfunctions of the service, including those due to technical problems, updates, maintenance, or force majeure events;
  • Any direct, indirect, incidental, consequential, punitive, or any other type of damages arising from the use or inability to use the Platform or from the information contained therein.

4.2 Liability Regarding Third Parties

  • Any transaction, booking, payment, cancellation, modification, or “no-show” is the exclusive responsibility of the third party (Hotel or affiliated platform).
  • Top World Hotel shall not be held liable for any errors, omissions, or service failures related to the commercial policies, contractual conditions, or management practices of the third parties.

4.3 Limitations on Financial Liability

  • In any event, the liability of Top World Hotel shall be limited to the maximum amount of the indicated booking or, where not applicable, to a nominal sum deemed sufficient to exclude any direct or indirect liabilities arising from the use of the Service.
  • These limitations apply to the fullest extent permitted by applicable law and do not prejudice any non-derogable rights in consumer protection, where applicable.

4.4 Force Majeure Clause

Top World Hotel shall not be held liable for any non-performance or delay in the execution of these Terms due to events beyond its reasonable control, including, but not limited to: wars, civil disturbances, acts of terrorism, natural disasters, strikes, governmental interventions, or other causes beyond the company’s control.


4.5 Indemnification Clause

The User agrees to indemnify and hold harmless Top World Hotel, its directors, employees, and affiliates from any liability, cost, expense, damage, or claim (including reasonable legal fees) arising from the improper use of the Platform or the use of the affiliated links, as well as from any claims brought by third parties in connection with the use of services offered by such third parties.

5. Coupons, Discounts, and Promotions

Any offers, promotions, coupons, or discounts displayed on the Platform are managed and governed exclusively by the affiliated third parties or Hotels. Top World Hotel does not intervene in the definition, validity, or application of such promotions and shall not be held liable for any discrepancies or errors related thereto.

6. Cancellation, Modification, and No-Show Policies

The conditions regarding cancellations, modifications, refunds, and “no-shows” are established exclusively by the third parties (Hotels or affiliated platforms) and are available on the respective website at the time of booking.

Top World Hotel does not manage, monitor, or guarantee the compliance with such policies; therefore, any disputes in this regard must be addressed directly to the responsible third party.

7. Communications, Redirections, and Contact Methods

7.1 Service Communications

All communications regarding the contractual relationship related to bookings, payments, customer support, and service conditions will be made directly by the third party (Hotel or affiliated platform) and not by Top World Hotel. For any contractual issues, the User must therefore contact the relevant partner directly.


7.2 Newsletters and Promotional Communications

Top World Hotel may periodically send newsletters and promotional communications to Users who have expressly consented to receive such communications, in accordance with our Privacy Policy. The User may revoke consent to receive newsletters at any time by following the instructions provided in those communications.


7.3 Obligation to Provide Contact Information

To ensure the proper functioning of the Service and the fulfillment of contractual obligations with third parties, the User is required to provide accurate, up-to-date, and verifiable contact information. Top World Hotel shall not be held liable for any errors or omissions in the data provided by the User.


7.4 Compliance with GDPR and Data Protection Regulations

Top World Hotel respects and is committed to ensuring the protection of Users’ personal data in accordance with the European General Data Protection Regulation (GDPR) and applicable national regulations. Further details regarding the collection, use, storage, and protection of data are available in our Privacy Policy, which is considered an integral part of these Terms.

8. Intellectual Property

8.1 Ownership of Content

All content, design, software, interfaces, texts, images, trademarks, and any other material available on the Platform are the exclusive property of Top World Hotel, third parties, or their respective content providers, and are protected by applicable copyright and intellectual property laws.


8.2 Prohibition of Unauthorized Use

It is expressly forbidden to copy, modify, reproduce, distribute, publicly communicate, or use in any form or manner the content of the Platform, unless prior written authorization is obtained from Top World Hotel or the rights holder. Any unauthorized use will constitute a material infringement of intellectual property rights and may result in legal action.

9. Governing Law and Dispute Resolution

9.1 Governing Law

These Terms are governed by and shall be construed in accordance with the laws of England. Any matter not expressly resolved by these Terms shall be interpreted in a manner that respects the non-derogable provisions for consumer protection, where applicable.


9.2 Jurisdiction

Any dispute arising from the interpretation, execution, or validity of these Terms shall be subject exclusively to the jurisdiction of the Courts of London (England and Wales). This choice of jurisdiction applies regardless of any mandatory provisions in the User’s country of residence.

10. Amendments and Updates to the Terms

Top World Hotel reserves the right to modify, update, or supplement these Terms at any time, with immediate effect upon publication on the Platform. The User is encouraged to periodically review this page for any updates. Continued use of the Platform after the publication of modifications constitutes unconditional acceptance of the new Terms.

11. Final Clauses

11.1 Entire Agreement

These Terms constitute the entire agreement between the User and Top World Hotel regarding the use of the Platform and supersede any previous agreements, written or oral, concerning the same subject matter.


11.2 Severability

Should any clause of these Terms be found invalid, ineffective, or unenforceable, the validity of the remaining clauses shall not be affected. In such a case, Top World Hotel undertakes to replace the invalid clause with a valid provision that, as far as possible, reflects the original intent of the parties.


11.3 Transparency and Data Monitoring

For issues regarding data transparency and the monitoring of affiliated links, Top World Hotel directs the User to refer to our Privacy Policy and Cookie Policy, where these aspects are treated in detail.
